Radio Pichincha Universal will present an extraordinary protection action in the Constitutional Court

«Let’s not make the right to communicate a persecution mechanism,» claimed the prefect.

The prefect of Pichincha, Paola Pabón, criticized the decision of the Court that withdrew the protection action, with which the Radio was able to return to the air after more than 15 days of being without signal in October 2019.

In this regard, she explained that it is not a coincidence that this sentence is issued when the presidential binomial of the Citizen Revolution is launched: Andrés Arauz-Rafael Correa.

She considers it to be another form of political persecution on the part of the Government of President Lenín Moreno.

Due to the risk that the Radio could go off the air again, she announced that she will present an extraordinary protection action in the Constitutional Court.

Christian Pérez, lawyer for the station, clarified that there would be no elements, in due process, for the radio to be closed. However, the prefect warned that there is a threat so they will take all actions so that the rights of citizens and freedom of expression are not violated.

An administrative process for the withdrawal of its enabling title is also open against the Radio. The lawyers have already filed the appeal and the Regulation and Control Agency (ARCOTEL) has not yet ruled on the matter. The lawyers pointed out that, in case the government entity does not give way to their appeal, they will go to other instances.

Paola Pabón also warned that the process takes place in the middle of a frequency contest organized by the Government and, if the enabling title is withdrawn, the station could also be delivered in that contest.

Radio Pichincha had two closures in 2019. The first in April, 12 days after Paola Pabón won the elections as Prefect of Pichincha.
