Council of the Judiciary enables windows to deal with food debt causes

The personnel of the Judicial Function will attend in the units with competence in matters of Flagrancy.

The director general of the Council of the Judiciary (CJ), Pedro Crespo, ordered that, in the judicial units with competence in Flagrancy matters, windows be opened to deal with procedures related to effective protection, due process and the right to liberty, in cases of urgency for food debts.

With this measure, the Judiciary seeks to guarantee constitutional principles during the health emergency due to the coronavirus.

According to the CJ, the windows will take care of procedures that go from the request for review of the constraint, payment formula, total cancellation of the debt, and request for release for the obligor who has complied with the constraint, as well as the payment of their obligations. .

The provision establishes that the officials of Flagrancia, who attend this type of procedures will communicate by telephone (or any other means) with the judge who knows the case and with their respective secretary, to act as appropriate in Law.

The judge, according to his powers, will verify in the computerized system of the Council of the Judiciary the values ​​to pay and those that are registered as accredited for alimony.

To comply with these actions, both judges and officials may use telematic tools to find out the cause. A similar process will be applied regarding the processing of processes related to national and international adoption.

In order to comply with this directive, the judges and secretaries, who have been notified of the need to attend to the cases, must go to the judicial units taking into account the security regulations established in the face of the health emergency.

In addition, the CJ requests the Provincial Directorates to give the judges and the personnel in charge of the process, the necessary facilities to carry out the proceedings.
